Beneath the Clouds of Law (Calder)
The afternoon light fell on my desk as Gilda's image stabilised on the screen. Studying law at the Central University of Venezuela requires a special mystique, one that my niece carries engraved in her coffee-coloured dark circles and criminal codes. That afternoon, just last week, our conversation drifted towards the architecture of crime: the mitigating factors that soften the shadow and the aggravating factors that darken it.
‘Uncle,’ she said, pointing to a stack of notes, ‘the process is an exercise in surgical pruning.’

She explained how, when reviewing the evidence in the file, justice becomes a relentless filter. There, anything that has no representative value on the punishable act simply vanishes. Well, today, at this moment, the phrase of the day resonated in my mind with absolute clarity: that which is ‘not representative of the facts’. In criminal law, the truth is not everything that happened in the infinite chaos of reality, but only that which allows the crime to be reconstructed under the magnifying glass of the law.
Any peripheral detail, however human or painful it may be, if it is not directly related to guilt or innocence, is discarded. It is a selection process in which anything that does not serve the rigour of the case is labelled as something that does not represent the facts. When I hung up, I was left thinking about the coldness of paper in the face of the complexity of life. Gilda is still there, at the UCV, learning that in a trial, only what is strictly factual survives.

La luz de la tarde caía sobre mi escritorio mientras la imagen de Gilda se estabilizaba en la pantalla. Estudiar Derecho en la Universidad Central de Venezuela requiere una mística especial, una que mi sobrina lleva grabada en sus ojeras de café y códigos penales. Esa tarde, precisamente la semana pasada, nuestra charla derivó hacia la arquitectura del delito: los atenuantes que suavizan la sombra y los agravantes que la oscurecen.
—Tío —me dijo, señalando un fajo de apuntes—, el proceso es un ejercicio de poda quirúrgica.

Me explicó cómo, al evacuar las pruebas en el expediente, la justicia se convierte en un filtro implacable. Allí, lo que no tiene un valor representativo sobre el hecho punible, simplemente se desvanece. Pues hoy, en este momento, la frase del día resonó en mi mente con una claridad absoluta: aquello que es "not representative of the facts". En el Derecho Penal, la verdad no es todo lo que ocurrió en el infinito caos de la realidad, sino solo aquello que permite reconstruir el crimen bajo la lupa de la norma.
Cualquier detalle periférico, por más humano o doloroso que sea, si no guarda una relación directa con la culpabilidad o la inocencia, es descartado. Es una selección donde lo que no sirve al rigor del caso es etiquetado como algo que no representa los hechos. Al colgar, me quedé pensando en la frialdad del papel frente a la complejidad de la vida. Gilda sigue allí, en la UCV, aprendiendo que en un juicio solo sobrevive lo que es estrictamente fáctico.
